Responsibility is shared between the owner and the driver.

The owner must ensure that the vehicle is in good condition when it is lent out. The driver must check that the vehicle is in good condition before starting to drive.

In the Road Traffic Act § 23, 'Responsibility for the vehicle's condition etc.' it is stated that during the driving itself, the driver alone is responsible for ensuring that the vehicle remains in good condition.
