Question 487 of 1002

If a driver is suspected of drunk driving, what will happen if the driver refuses to take a blood alcohol test?

Justification

The blood test may, if necessary, be taken by force.

There used to be a provision in the Road Traffic Act stating that your licence would be suspended for at least 2 years if you refuse to provide a blood sample. This provision does not exist any longer. Therefore, you are unable to refuse a blood alcohol test; the Road Traffic Act now states that a blood sample may be taken by force.

Options
Their driving licence will be suspended for at least 3 months
The driver will be punished with imprisonment and fines, and their licence will be suspended for 5 years
The blood alcohol test may, if necessary, be taken by force
Their driving licence will be suspended permanently
