The owner has a duty to check that the person they lend the car to has a valid driving licence. In The Road Traffic Act, it is stated that the owner of a motor vehicle, or whomever the owner has granted access to the motor vehicle, is obligated to ensure that the person using the motor vehicle meets all requirements to drive it. For example, this means that a person who lends their car to someone else must be certain that the person borrowing the car has a valid driving licence and is not under the influence of alcohol and/or other intoxicants. |
